NJ Park Service tries to ban Mil Veh - Update Aug 13

Discussion of Local, State, and Federal issues regarding MV Legislation, MV use restrictions, MV registration refusals, etc. As these issues may ultimately affect other jurisdictions, information and education of all MV owners is crucial for the future ownership and use of our MVs.

It looks like the NJ State Park Service is looking to ban all military vehicles from areas they control. This could include public roads through state parks and forests - not just off road use.
Although I was assured this was not meant for the law abiding MV owner who rides through the parks, it gives the NJ State Park Police huge latitude in interpreting and enforcing the law.
So a Jeep Wrangler would be OK, but a Willys MB would not be OK. A Humvee would be banned but a Hummer H1 would be OK. It makes little sense.

Read the propsed change below and contact your state representatives!

N.J.A.C. 7:2-3.2 Unauthorized motor vehicle use:
Proposed change:
"Except in accordance with N.J.A.C. 7:2-3.4(d), a person shall not operate or permit the operation on or over lands or in or on waters under the jurisdiction of the State Park Service of a motorized vehicle likely to cause damage or injury to persons, wildlife, or property within the jurisdiction of the State Park Service. Such vehicles include, but are not limited to, a motor vehicle having more than two axles and capability of four-wheel drive, an ATV, military-designed or surplus vehicle (whether or not modified for civilian use), or an unlicensed or unregistered motor vehicle."

I would say use of civilian vehicles will follow in a few years, as restrictive as that language is.

That statement gives them a huge swath to say what is banned. Not good.

I just got a call from a friend in the State Park Service who said the phrase "military-designed or surplus vehicle (whether or not modified for civilian use)" has been deleted from the proposed rule change.

This is good news and was brought about by the many (I believe he said hundreds) of written comments received from residents.

Update as of 25 August 2013. The NJ Park Service has modified the proposal to now exempt military vehicles from this rule change. It DOES NOT exempt any vehicles which have more than two axles or tires larger than 40 inches. So deuces and bobbed deuces, 5-tons and big trucks will still be banned.

The rule change is open for comment until October 2013. Our comments on this horrible rule change got the majority of our vehicles exempted from the ban. If you want to comment on the changes the link to the regulation is here:

If you support the changes, you should write and let them know you endorse the changes. It is also helpful to let your legislators know you appreciate their support of this rule change.

The intent was to ban vehicles that were causing damage to parklands and fragile ecosystems like the pine barrens.
The guys who make their own trails, dig big mud wallows, and off road in closed/historic/fragile areas.

The ban was so far reaching that it gave park police the authority to stop a historic jeep (licensed) that was on a public road within a park. It was not well thought out and was pretty obviously written by folks who knew nothing about the MV hobby.

The new proposed rule would still ban deuces, vehicles with more than two axles, any vehicle with 40 inch or greater tires, unlicensed vehicles, and ATV's.
